Understanding Florida Divorce Law

Florida is considered a “no-fault” divorce state, which means that neither party has to have committed a wrong for the divorce to be granted. What most people refer to as divorce is called “absolute divorce” in Florida. (This term distinguishes the complete dissolution of a marriage from “divorce from bed and board,” more commonly known as legal separation.)

In order to be granted an absolute divorce in most cases, the following criteria must be met:

  • One spouse has lived in Florida for at least six months;
  • The parties have lived separate and apart for one year;
  • The parties have lived apart because they want to end their marriage;
  • In certain narrow circumstances, Florida courts will also grant an absolute divorce on the grounds of incurable insanity, which requires the spouses to have lived separately for three years because one spouse was confined for purposes of medical treatment.

An absolute divorce in Florida completely dissolves the marriage but may not address such issues as property division, alimony, child custody, and child support. This is why having an experienced family law attorney is essential. Contrary to many people’s belief that all divorces go to trial, most Florida divorces are settled.
